Neutral Citation No. - 2025:AHC-LKO:34909-DB Court No. - 2 Case :- WRIT - C No. - 5679 of 2025 Petitioner :- Subodh Kumar Singh And 2 Others Respondent :- State Of U.P. Thru. Prin. Secy Forest Lko. And 3 Others Counsel for Petitioner :- Durgendra Kumar Tiwari Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Praveen Kumar Giri,J.
1. Let the opposite party no. 3 re-visit his order dated 14.05.2025, impugned herein, in the light of the assertions of the petitioners that the money is to be deposited only in the event the petitioners are unable to plant 10 trees for each of the trees cut by them, and that eventuality has not reached as yet. Therefore, for the officer to demand that the petitioners should submit National Savings Certificates without even mentioning as to what is the value of the said certificate, is incongruous. Prima facie, this contention does appear to be correct. Without drawing any conclusive opinion, it is better for the officer to re- visit his order and take a fresh decision as to whether some money is to be deposited at this stage or after grant of permission if the petitioners are unable to plant 10 trees as mentioned therein.
2. Let a fresh decision be taken within ten days from the date of receipt of certified copy of this order.
3. The writ petition is, accordingly, disposed of.
4. Sri Manish Mishra, learned Standing Counsel to communicate this order to opposite party no. 3. Order Date :- 6.6.2025 K.K. Maurya (Praveen Kumar Giri, J.) (Rajan Roy, J.) Digitally signed by :- KAMLESH KUMAR MAURYA High Court of Judicature at Allahabad, Lucknow Bench
