Neutral Citation No. - 2025:AHC-LKO:23946-DB Court No. - 2 Case :- WRIT - C No. - 14939 of 2018 Petitioner :- Kedar Nath Gupta And Others Respondent :- State Of U.P. Thru. Prin. Secy. Housing And Urban Dev. And Ors. Counsel for Petitioner :- Mahendra Pratap Singh,Meenakshi Singh Parihar,Vinod Kumar Counsel for Respondent :- C.S.C.,Anupam Dwivedi,Gaurav Mehrotra Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J.
1. Heard Shri H.G.S. Parihar, learned Senior Counsel appearing for the petitioners, learned Additional Chief Standing Counsel for the State and Shri Anupam Dwivedi,
learned counsel for the PDA.
2. This writ petition was filed way back in 2018 assailing certain orders as also challenging the vires of certain bye laws of Development Authority concerned, however, in view of the subsequent Government Order dated 22.11.2023, copy of which is annexed as Annexure SCA No. -2 to the short counter affidavit filed by the Prayagraj Development Authority and is also annexed by the petitioners elsewhere, learned Senior Counsel appearing for the petitioners says that their application which is referable to the said Government Order may be considered.
3. Learned counsel for the PDA sought to demonstrate certain difficulties on account of Para 3 of the said order, however, we are of the opinion that if an application has been submitted by the petitioner after completing all the formalities as is envisaged in the Government Order dated 22.11.2023, then, the Development Authority should consider and take such decision as is deemed fit but as per law, with expedition, say, within a period of three months of submission of such application.
4. The petitioners may submit the aforesaid application at the earliest.
5. We have not considered the applicability of the Government Order to the petitioners' case which should also be considered by the Development Authority.
6. The writ petition is disposed of accordingly. . (Om Prakash Shukla,J.) (Rajan Roy,J.)
