Neutral Citation No. - 2025:AHC-LKO:34598-DB Court No. - 2 Case :- WRIT - C No. - 5610 of 2025 Petitioner :- Vikram Singh Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Revenue Lko And 5 Others Counsel for Petitioner :- Chandra Bhanu Singh Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Rajan Roy,J. Hon'ble Praveen Kumar Giri,J. 1. Heard. 2. Petitioner alleges encroachment on his bhumidhari land for the construction of a Chakroad, allegedly by the opposite party Gram Pradhan. The petitioner may get the boundaries of his Gata demarcated under Section 24 and based on such demarcation, if it is found that the Chakroad has been constructed within the boundaries of petitioner's Gata, which in fact appears to be a joint holding, then remedial measures will have to be taken by the Gram Pradhan if he is undertaking construction of the Chakroad. In fact, whosoever is undertaking construction of the Chakroad or if it is proposed to be constructed, would be better advised to get the relevant Gata, which is earmarked for the Chakroad, demarcated so that any bhumidhari land is not encroached upon illegally. 3. As a result of the aforesaid demarcation, if it is found that the petitioner's bhumidhari land has been encroached upon then it will have to be removed unless the petitioner consents to sell it or to receive compensation as per law. 4. The petition is, accordingly, disposed of. Order Date :- 4.6.2025 K.Tiwari (Praveen Kumar Giri, J.) (Rajan Roy, J.)
