This writ petition has been filed under Article 227 of the Constitution of India, whereby the petitioners sought a direction that learned Assistant Collector, Ist Class/Sub-Divisional Magistrate, Kashipur, Udham Singh Nagar be directed for expediting the proceedings of Misc. Case No.22/5 of 2024-25 (22/05 of 2023-24), Manjit Singh and another Vs. Malkeet Singh and others, preferably within one month. 2. It is case of the petitioner that an application for correction of the final decree dated 31.01.1991 has been moved in the court of learned Assistant Collector, Ist Class/Sub-Divisional Magistrate, Kashipur, Udham Singh Nagar on 31.03.2023. 3. The respondent has put in appearance in the said application which has been registered as Misc. Case No.22/05 of 2023-24, they have filed their objection as well and the cross objection has also been filed by the petitioners. 4. It is contended by counsel for the petitioners that the application is pending disposal since 2023 which is causing unnecessary hurdle in the administration of 1 2025:UHC:10019 justice in favour of the petitioners. 5. Having heard learned counsel for the parties and having perused the application as well as the order- sheet annexed by the counsel for the petitioners, this Court is of the view that it is a fit case wherein a direction can be issued for expeditious disposal of the aforesaid application for correction of the decree on merits. 6. Accordingly writ petition stands allowed. Learned Assistant Collector, Ist Class/Sub-Divisional Magistrate, Kashipur, Udham Singh Nagar is directed to hear and conclude the Misc. Case No.22/5 of 2024-25 (22/05 of 2023-24), Manjit Singh and another Vs. Malkeet Singh and others, expeditiously not later than six months from the date of production of certified copy of this order.
