JUSTICE AHANTHEM BIMOL SINGH 22.08.2025 Heard Ms. W. Geetarani, learned counsel appearing for the petitioner; and Mrs. L. Monomala, learned G.A. appearing for the respondents. The present writ petition has been filed assailing the order dated 13.03.2025 issued by the Commissioner (Hr. & Tech. Edn.), Government of Manipur, placing the petitioner under suspension in exercise of the powers conferred by Rule 10(2)(a) of the CCS(CCA) Rules, 1965. The only ground on which the said suspension order is challenged is that the authorities did not extend the period of the petitioner’s suspension before expiry of 90 days as provided under Rule 10(6) & 10(7) of the CCS(CCA) Rules, 1965. In terms of the earlier direction given by this Court, Mrs. L. Monomala, learned G.A., placed before this Court a letter dated 20.08.2025 from the Secretariat: Higher & Technical Education Department, wherein, it has been stated that the period of suspension of the petitioner was not extended further by the department before expiry of the 90 days as provided under the aforesaid LAIRENM AYUM INDRAJE ET SINGH Digitally signed by LAIRENMAYUM INDRAJEET SINGH Date: 2025.08.22 15:16:53 +05'30' 2 Rule 10 of the CCS(CCA) Rules, 1965. The said letter is marked as ‘X’ for identification and placed on record. As the authorities have stated that the period of suspension of the petitioner has not been extended further as provided under Rule 10(6) & 10(7) of the CCS(CCA) Rules, 1965, the impugned suspension order is rendered invalid by operation of law as provided under Rule 10(7) of the CCS(CCA) Rules, 1965. Accordingly, the impugned suspension order dated 13.03.2025 issued by the Commissioner (Hr. & Tech. Edn.), Government of Manipur, is hereby quashed & set aside. Consequently, the authorities are directed to reinstate the petitioner forthwith with all consequential benefits as provided under the Rules. With the aforesaid direction, the present writ petition is disposed of. JUDGE Indrajeet
