By means of this petition, the petitioners have sought the following main reliefs:- "(1). issue a writ order or direction in the nature of certiorari to quash the impugned order dated 18.07.2019 passed by the opposite party no.1 contained in Annexure no.1 to the writ petition. (ii). issue a writ order or direction in the nature of certiorari to quash the impugned report dated-09.08.2018, submitted by the opposite party no,2 contained as Annexure No.2 to this writ petition. (iii). issue a writ, order or direction in the nature of mandamus commanding and directing the opposite parties no. 2, 3 and 4 to take appropriate and legal action upon the application made by the petitioner, thereby they may remove the discrepancy in the revenue record in relation to land Gata No.60 M/1-12 and land Gata No.167/2-15 (Old Gata No.59 M/1-12 and 137/2-15/17) of Khata No.86, situated at Village-Kanakpur Ehatmali, Pargana-Nawabganj, Tehsil-Tarabganj, District-Gonda. (iv). issue a writ, order or direction in the nature of mandamus, directing the opposite parties to not to take any coercive and illegal action against petitioners, in pursuance to the order passed by the opposite party no.1." The order impugned dated 18.07.2019, which is extracted hereunder, passed by opposite party No. 1/Collector/District Deputy Director Consolidation, Gonda (in short "DDC") in exercise of power under Section 48(3) of U.P. Consolidation of Holdings Act, 1953 (in short "Act of 1953") in Case No. 03034/2018, Computerized Case No. D201808300003034 (State vs. Bhanu Pratap Singh and others) has been challenged on the ground that proper opportunity of hearing in terms of Section 48(2) of the Act of 1953 was not provided to the petitioners and also that in terms of the order passed by the Consolidation Officer concerned dated 20.07.1962 in Case No. 5090, the name of predecessor the petitioners namely Chandrabhan Singh s/o Ramraj Singh was recorded in the revenue records related to Gata No. 60M/1.12 Acre and Gata No. 167/M/2.15 Acre (Khata No. 86), which was initially recorded in the name of Gaon Sabha, as such, the order impugned dated 18.07.2019 passed without giving proper opportunity of hearing is liable to be interfered with by this Court, more so when, the same is based upon the photocopies of relevant documents taken note of by the DDC. " पभभरर अधधकभरर, रभजसव अभभललखभगभर, गगणडभ कक आखयभ भदनभनक 09.08.2018 दभरभ अवगत करभयभ गयभ हह भक शर उदयभभन धसनह पपत जगदरश धसनह भनवभसर गभम कनकपपर परगनभ नवभबगनज तहसरल तरबगनज धजलभ गगणडभ कल भशकभयतर पत भदनभनक 14.05.218 कल समबनध मम जजच कक गयर। भशकभयतर पभररनभ पत मम कहभ गयभ हह भक गभम कनकपपर एहतमभलर परगनभ नवभबगनज तहसरल तरबगनज धजलभ गगणडभ कल जभतल चकबनदर आकभर पत 45 मम खभतभ सनखयभ 86 ( पभनर खभतभ) पर फजर ढनग सल अनभकत अमलदरभमद कग भनरसत भकयल जभनल कभ अनपरगध भकयभ गयभ हह। पशनगत अमलदरभमद मम उललख हह भक ' आदलशभनपसभर शरमतर चकबनदर अधधकभरर, रभमभपपर मपकदभ नमबर- 5090/20.07.1962 कग आदलश हहआ भक पपरभनर गभटभ सनखयभ 5918/1.12 एकड, 137/17 भम/2.15 एकड, नयभ गभटभ सनखयभ 60 भम0/1.12 एकड, 167 भम/2.15 एकड गभनवसभभ खभतभ सनखयभ 86 सल खभररज करकल चनदभभन धसनह पपत शर रभमरभज धसनह सभभकनदलह कभ नभम बततरसररदभर दजर भकयभ जभवल" मभलगपजभरर 32.70 पहसल दजर हह। हसतभकर चनददलव यभदव ललखपभल 08.10.1962 ई० व हसतभकर चकबनदरकतभर 08.10.1962 ई 0 भशकभतकतभर दभरभ भशकभयतर तथयय कल समररन मम रभजसव अभभललखभगभर सल उक खभतल कक भनगरत नकल भदनभनक 03.05.1989 तरभ 05.10.1990 कक छभयभपभत दभधखल भकयभ गयभ हह। भशकभयतर पत मम उभलधखत तथयय कक जभजच बनदगबसत अधधकभरर चकबनदर गगणडभ सल करभयर गयर। बनदगबसत अधधकभरर चकबनदर गगणडभ कल पत भदनभनक 12.07.2018 दभरभ चकबनदर अधधकभरर कक आखयभ भदनभनक 15.06.2018 उलबध करभयर गयर हह धजसमल उललख हह भक परम चक चकबनदर कल धजलद बनदगबसत कल खभतभ सनखयभ 86 पभनर कल खभतभ मल गभटभ सनखयभ 60 भम 0/2.68 एकड , 167/3.05 एकड अनय गभटय कल सभर दजर हह , धजस पर कगई अमलदरभमद दजर नहह हह। यह पभतधलभप रभजसव अभभललखभगभर सल भदनभनक 03.05.1989 कग भनगरत हह , तग उसकल बभद वतरमभन मल भदनभनक 18.10.1962 कग कक गयर अनकनभ कक टरभचत एवन फजर पतरत हगतर हह। इसकल अभतररक तहसरलदभर , तरबगनज कल आदलश भदनभनक 08.02.1989 दभरभ गभटभ सनखयभ 60/1.00 एकड , 167/2.00 एकड सल खभतलदभर चनदभभन धसनह , सतरभभन धसनह पपतगण रभमरभज धसनह कभ नभम खभररज करकल वगर -6 जलमग भकभम कल खभतल मम दजर भकयल जभनल कभ आदलश आधभर वरर खततनर कल खभतभ सनखयभ 16 पर अनभकत हह। इस पकभर कक टरभचत ढनग सल बढभयभ गयभ गभटभ सनखयभ 60 भम /1.00 एकड , 167/2.00 एकड पपनन पभनर कल खभतल मम वभपस भकयभ जभ चपकभ हह भकनतप पकवर मम कक गयर कक टरचनभ कल आधभर पर परम चक चकबनदर कल पभनर कल खभतभ सनखयभ 86 पर आदलश चकबनदर अधधकभरर वभद सनखयभ 5090/20.07.1962 दजर हह। सरकभर अभभललख मम फजर अनकनभ कल बनल रहनल कभ कगई औभचतय नहह हह। इस भबनदप पर मभ० रभजसव परररद उ०प० लखनऊ दभरभ वरर 2009 आर०एल०टर०-710 जय पकभश आभद बनभम एल०एम०सर० मल पभतपभभदत भवधध वयवसरभ पभसनभगक हह, धजसमल यह धसदभनत धभररत भकयभ गयभ हह भक फजर पभवभष कग रभजसव अभभललखय मल बनभयल नहह रखभ जभ सकतभ हह। इस फजर अनकनभ कग जगत चकबनदर अधधभनयम कक धभरभ 48 (3) व रभजसव सनभहतभ 2006 कक धभरभ 38(5) कल अनतगरत भनरसत भकयभ जभ सकतभ हह पतभवलर पसतपत हहई। सरकभर कक ओर सल धजलभ शभसककय अधधवकभ (रभजसव) उपससरत हह, अनय कगई पककभर उपससरत नहह हह। मलरल दभरभ पतभवलर पर उपलबध समसत अभभललखय कभ समयक रप सल पररशरलन भकयभ गयभ। पभभरर अधधकभरर, रभजसव अभभललखभगभर कक जजच आखयभ सल सवतन धसद हह, भक गभम कनकपपर एहतमभलर परगनभ नवभबगनज तहसरल तरबगनज धजलभ गगणडभ कल जभत चकबनदर आकभर पत 45 खभतभ सनखयभ 86 ( पभनर खभतभ) पर अनभकत फजर अमलदरभमद भदनभनभकत 08.10.1962 फजर व कक टरभचत हह, जग भनरसत भकयल जभनल यगगय हह। अतन उक फजर पभवभषयभन एतदद दभरभ भनरसत भकयभ जभतभ हह। आदलश कक पभत पभभरर अधधकभरर रभजसव अभभललखभगभर कग इस भनदरश कल सभर पलभरत भक समबसनधत अभभललखय मल इसकक अनकनभ करभ दर जभय। पतभवलर बभद आवशयक कभयरवभहर पतभवलर दभधखल दफतर कक जभय।" Per contra, side opposite opposed instant petition based upon the observations and findings made by the DDC in the impugned order dated 18.07.2019 based upon the copies of relevant Khata(s) dated 03.05.1989 and 05.10.1990 and also the order dated 08.02.1989 passed by Additional Tehsildar, Tarabganj, Gonda in compliance of which, the land of Gata No. 60/1.00 Acre, 167/2.00 Acre has been recorded as Varg-6 land (Jalmagn Bhoomi) in the revenue records after expunging the name of predecessor of the petitioners namely Chandrabhan Singh and also of Sattibhan Singh, both sons of Ramraj Singh. It would be apt to indicate here that for the reasons best known to the petitioners' counsel, the order dated 08.02.1989 has not been placed on record and no ground has been taken in the petition in this regard. Thus, the validity of the order dated 08.02.1989 has not been impeached. It would also be apt to indicate here that Writ-B No. 135/2010 (Bhanu Pratap Singh S/O Chandra Bhan Singh vs. Deputy Director Consolidation Gonda And Ors.) was filed by the petitioner and Gata No. 60M was the subject matter of this petition, which is also the subject matter of the instant petition. The aforesaid petition was dismissed by this Court vide order dated 15.02.2024 affirming the findings recorded by the Consolidation Authorities in the orders impugned therein under the Act of 1953, as per which, Gata No. 60M was Varg- 6 land (Jalmagn Bhoomi). On being asked at this stage, petitioners' counsel Sri Alok Srivastava says that the order dated 15.02.2024 passed by this Court in Writ-B No. 135/2010, detailed above, has not been challenged till date. Upon due consideration of the aforesaid, this Court finds no force in the instant petition filed based upon the ground of opportunity of hearing, which in fact, would be a futile exercise, if granted. The petition is accordingly dismissed. It is for the following reasons:- (i) The validity/veracity of the order dated 08.02.1989 passed by the Tehsildar concerned has not been impeached. (ii) The order dated 15.02.2024 passed by this Court in Writ-B No. 135/2010 has not been challenged, thus, the same is intact.
