Neutral Citation No. - 2025:AHC-LKO:34544 Court No. - 4 Case :- WRIT - C No. - 5629 of 2025 Petitioner :- Subhash Chandra Respondent :- State Of U.P. Thru. Collector Lko And 3 Others Counsel for Petitioner :- Ram Janak Yadav,Maya Ram Yadav Counsel for Respondent :- C.S.C.,Dilip Kumar Pandey Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of the respondents No.1 and 2 has been accepted by the office of Chief Standing Counsel. Shri Dilip Kumar Pandey, learned counsel has accepted notice for the respondent No.3. Learned standing counsel has raised a preliminary objection regarding the maintainability of the instant petition inasmuch as the order has been passed in proceedings under Section 229-B of the U.P. Z.A. & L.R. Act, 1950 (for short, 'the Act of 1950'). It is further stated that by means of the impugned order, the Court has merely condoned the delay and fixed the matter for hearing and against the aforesaid order, the instant petition is not maintainable as the petitioner has already taken recourse in terms of the Act of 1950.
Learned counsel for the petitioner, after arguing at some length, could not dispute regarding the availability of statutory remedy. In view of the aforesaid, this Court is not inclined to entertain the petition leaving it open for the petitioner to take recourse to the statutory remedy. With the aforesaid, the petition stands dismissed.
