Heard. 2. Perused the order dated 16.06.2023 passed by this Court, till date the final assessment has not been brought on record. We, therefore, provide that if no final assessment has been made and communicated to the petitioner as per rules then the impugned recovery shall not be given effect, however, it shall be open for the concerned opposite parties to make a final assessment and communicate it to the petitioner, however, if such final assessment has already been made then the same should be communicated to the petitioner and in that eventuality, the recovery shall not be treated as stayed but with liberty to the petitioner to challenge the said final assessment, if the later situation exists let this be done within six weeks. 3.
