2. The present petition under Section 528 of the BNSS, 2023 has been filed by the petitioner seeking following prayers :-
“It is therefore prayed that this Hon’ble Court may kindly be pleased to allow this petition and to set-aside/ quash the First Information Report registered at police station Jutmil, Raigarh, District Raigarh Chhattisgarh in Crime No. 286/2024 under section 420, 120-B, 406 of the Indian Penal Code and Section 7 of the Chhattisgarh Gambling (Prohibition) Act, 2022 against the accused persons as well as criminal proceeding of criminal Case No.1360/2024 pending before the learned Judicial Magistrate Class Raigarh, District Raigarh Chhattisgarh against the petitioner, in the interest of justice.”

Learned counsel for the petitioner submits that he wants to withdraw the instant petition on the ground that the petition as become infructuous as the petitioner has already been acquitted of the charges.
