Controversy raised in the present appeal is squarely covered by a previous adjudication of this Court in Special Appeal (Defective) No. 976 of 2023. 6. Sri Ashish Mohan Srivastava appearing for the State does not dispute the above fact but merely states that the order of the competent authority was passed after the rules were amended. 7. Considering the fact that issue raised in the present appeal stands adjudicated by this Court in Special Appeal (Defective) No. 976 of 2023 decided on 24.01.2024, this appeal also fails and is dismissed for the reasons recorded in the judgement of the coordinate Bench in the aforesaid matter.
