Neutral Citation No. - 2025:AHC-LKO:33887 Court No. - 6 Case :- WRIT - C No. - 5536 of 2025 Petitioner :- Smt. Mamta Shukla Respondent :- State Of U.P. Thru. Prin. Secy. Panchayati Raj Lko. And 2 Others Counsel for Petitioner :- Rakesh Kumar Srivastava,Veerendra Kumar Tiwari Counsel for Respondent :- C.S.C.,Ripu Daman Shahi,Surya Prakash Singh Hon'ble Pankaj Bhatia,J.
1. Heard learned counsel for the petitioner, Shri R.D. Shahi,
learned counsel for the respondent and the learned Standing Counsel.
2. The present petition has been filed by the petitioner challenging an order dated 25.5.2025 whereby an order has been passed against the petitioner removing her as a Gram Pradhan.
3. The counsel for the petitioner argues that admittedly, as per the records, the show cause notice was sent on 22.5.2025 and was received on 27.5.2025 at about 02.30 PM. He further argues that even as per the impugned order, the notice was pasted on the notice board on 23.5.2025 and without giving a reasonable opportunity of filing the reply, the impugned order has been passed.
4. Learned Standing Counsel, based upon instructions, could not dispute the material facts as alleged with regard to service of the notice.
5. Thus, on the sole ground that the proper opportunity of hearing and filing the reply was not accorded to the petitioner and there was a violation of the principles of natural justice, the
order impugned dated 25.5.2025 is quashed.
6. As the petitioner has now received the show cause notice, she is directed to file her reply within 10 days from today i.e., on or before 10.06.2025. The respondent no. 2 shall thereafter pass fresh orders within a further period of two weeks i.e., on or before 30.6.2025, in accordance with law.
7. The present petition is allowed with the said directions.
