THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioners have sought for the following relief:- “In the facts and circumstances of the case, it is most respectfully prayed that this Hon’ble Court may kindly be pleased to quash the entire proceedings in C.C.No.4514/2024 for the offences alleged under Sections 498A, 504, 506 r/w 34 of Indian Penal Code (“IPC”) and Sections 3 and 4 of Dowry Prohibition Act (“DP Act”) on the file of XI Additional Chief Judicial Magistrate at Bengaluru (Produced as Annexure-A) as against the Petitioners in the interest of justice and Equity.” 2. Learned counsel for the petitioners – accused Nos.1 to 3 has filed Joint Affidavit duly signed by the petitioners, 2nd respondent and their respective counsel and the same is taken on record. - 3 - NC: 2025:KHC:3072 CRL.P No. 820 of 2025 3. Petitioners – accused Nos.1 to 3 and their counsel and respondent No.2 and her counsel are physically present before the Court and they admit the contents of the Joint Affidavit, which reads as under:- “JOINT AFFIDAVIT “We, Manjunath K R S/o Ramanjaneya, Aged about 38 years, Padma, W/o Ramanjaneya, Aged about 62 years, Sri Ramanjaneya S/o Hanumantharayappa, Aged about 71 years, residing at #9, 1st Main, 18 B-cross, N.S. Palya, BTM 2nd Stage, Bengaluru City, Karnataka and Anu Revamma Parvathi D/o Sri Manje Gowda, Aged about 34 years, residing at #138, 8th Cross, 4th Main, Near TIFR, Sharada Nagar Yelahanka New Town, Bengaluru City, Karnataka – 560006, do hereby solemnly affirm and state on oath as under:- 1. We submit that we are aware of the facts and circumstances of the above petition and we are competent to swear to this affidavit. 2. We submit that, Anu Revamma Parvathi had filed a complaint against Manjunath K.R., Ramanjaneya, Padma and Ashwini Pradeep, before the East Zone Women Police Station under the Crime No.115/2023 which culminated in Respondent No.1 filing a charge sheet against Manjunath K.R., Ramanjaneya, Padma for the alleged offences under Sections 498A, 504, 506 r/w 34 of Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act in C.C.No.4514/2024, which is pending on the file of XI Addl. Chief Judicial Magistrate, Bengaluru. - 4 - NC: 2025:KHC:3072 CRL.P No. 820 of 2025 3. We submit that, pursuant to same, we have amicably resolved the disputes between us during the mediation proceedings conducted in M.C.No.247/2023 before the Hon’ble V Additional Principal Judge, Family Court Bengaluru. By the Judgment and decree dated 18 December 2024, the marriage solemnized between Petitioner No.1 and Respondent No.2 on 19.09.2018 is dissolved by the decree of divorce and the terms of settlement agreed between the Parties forms part of the Decree. Pursuant to said settlement, Respondent No.2 has agreed to withdraw the allegations levelled against Petitioners and has agreed to cooperate with the Petitioners for quashing of criminal case in C.C.No.4514/2024, pending on the file of XI Addl. Chief Judicial Magistrate, Bengaluru for the alleged offences under Sections 498A, 504, 506 r/w 34 of Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act. 4. We have settled and amicably resolved the dispute as against each other, no useful purpose is likely to be served to continue with the proceedings of the aforesaid case, hence the present petition. We have resolved the dispute between us unconditionally. 5. We submit that, we have further assured each other that even in future, we shall not file any case, complaint or claim against each other before any court or law or before the Police Authority or before any other authority regarding any disputes / claims and differences. Wherefore, it is humbly prayed that this Hon’ble Court may kindly be pleased to quash the entire proceedings in C.C.No.4514/2024, which is now pending on the file of XI Addl. Chief Judicial Magistrate, Bengaluru for the offences - 5 - NC: 2025:KHC:3072 CRL.P No. 820 of 2025 punishable under Sections 498A, 504, 506 r/w 34 of Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act; We the deponents do hereby declare that what is stated above is true and correct to the best of our knowledge, belief and information and the signatures found in this affidavit are our own;” 4. In view of the aforesaid settlement entered into between the petitioners and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Affidavit dated 17.01.2025. (ii) The proceedings in C.C.No.4514/2024 (arising out of Crime No.115/2023 of 1st respondent – Police) registered for the offences punishable under Sections 498A, 504, 506 r/w 34 of IPC and Sections 3 and 4 of the Dowry Prohibition Act pending on the file of XI Addl.
