Heard Shri Shashank Dwivedi, holding brief of Shri Raj Mani Dubey, learned counsel for the petitioners, learned A.G.A. for the State as well as respondent no.2, who is present in person before this Court and perused the record. 2. Learned counsel for the petitioners, at the outset, submits that he be permitted to withdraw this petition as the same has become infructuous in view of the order dated 13.08.2024 passed by a Coordinate Bench of this Court in Matters Under Article 227 No.4070 of 2023. 3. The respondent no.2 appearing in person has raised many objections with regard to the conduct of the petitioners in filing multiple petitions. It is submitted that in this petition as well as in Matters Under Article 227 No.4070 of 2023, identical prayers have been claimed and thus the petitioners are misusing the procedure of law. 4. Keeping in view the prayers claimed by the petitioners in the instant petition i.e. Matters Under Article 227 No.12233 of 2019 and in Matters Under Article 227 No.4070 of 2023, though there are some prayers, which may be said identical, but the petitioners, in the considered opinion of this Court, may not be compelled to litigate when he is himself opting out. 5. Having regard to the request made on behalf of the petitioners, the instant petition is dismissed as withdrawn.
