ORAL ORDER
Heard the learned counsel for petitioner, learned High Court Government Pleader for Respondent/State and perused the material on record. 2. FIR in Crime No.111/2020 of Rajarajeswarinagara Police Station, Bengaluru City, is registered against two named accused and 6-7 others, for offences punishable under Sections 307, 397, 364, 384, 448, 323, 342, 120(B), 506(B) read with 149 of IPC. 3. On completion of investigation, the Police have filed charge sheet against accused Nos.1 to 10. Petitioner is arraigned as accused No.10. 4. Briefly stated, case of the prosecution is that there was love affair between the complainant and CW-9, daughter of accused No.10. The complainant had a private video of CW-9. Therefore, petitioner/accused No.10 was requesting him to delete the said video, as the said video would come in the way of her daughter’s marriage. She informed the matter to

accused No.1 and assured that he will be provided financial support and she will help him get some post in politics. It is alleged that at her instigation, on 30.05.2020 at about 8:30 p.m., complainant was abducted by other accused and they snatched Rs.16,000/-, ATM Cards, house key, bike key from him and then took him behind Global Village, threatened him to handover the video and assaulted him with a dagger, knife, wooden club etc. Further, they went to his house and took away two pen drives and deleted the video from the said pen drives and demanded Rs.2 lakhs from him. 5. The allegations against the petitioner in the charge sheet is that at her instance, other accused persons abducted the complainant and robbed him and also took away the pen drive from his house and deleted the video, assaulted and threatened him etc. 6. In the FIR, name of the petitioner is not mentioned. While filing charge sheet, she has been arraigned as accused No.10. It appears that on the basis of the voluntary statement of the co-accused, she has been named as an accused in this case. In the charge sheet, it is mentioned that accused No.10

was not arrested. Since, a request was made by the police to issue NBW, the Court issued NBW to the petitioner. 7.
The learned Sessions Judge while dismissing the bail petition has observed that the petitioner has been absconding and if a person is declared as an absconder/proclaimed offender in terms of Section 82 of Cr.P.C., is not entitled for the relief of anticipatory bail. 8. In view of abscondence of the petitioner, case against her is split up. The main allegation of kidnapping the victim etc. are against other accused persons. The allegation against the petitioner have to be proved in due course. At this stage, there is no sufficient material to show that at her behest or instigation, other accused kidnapped the victim and committed robbery etc. Considering that the NBW is issued against the petitioner, she can be directed to appear before the jurisdictional Court and file necessary application to recall the NBW and for bail. If any such application is filed within 15 days from today, the jurisdictional Court shall pass necessary orders and enlarge the petitioner on bail on the same day imposing suitable conditions. - 5 -

9. The petitioner shall strictly adhere to all the conditions imposed by the Court. 10. The Criminal Petition is disposed of. Sd/-
