The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 109, 118(2), 329, 351(3), 3(5) BNS, 2023 and Section 27 of Arms Act. 3. Learned counsel for the petitioner has submitted that petitioner is innocent and has been falsely implicated in this case, only on the basis of confessional statement of co-accused person. It is further submitted that petitioner has not fired in the house of the informant and no fire arms or article has been recovered from the possession of the petitioner. It is further submitted that other co-accused persons have been granted bail by the Co-ordinate Bench of this Court vide order dated 04.03.2025 passed in B.A. No. 1753 of 2025 and vide order dated 29.04.2025 passed in B.A. No. 3193 of 2025. It is further submitted that petitioner is a daily wage labour and he has no criminal antecedent. Petitioner is languishing in judicial custody since 04.12.2024. As such, he may be enlarged on bail. 4. Learned A.P.P. has opposed the prayer for bail. 5. Having regard to the facts of the case and looking to the allegation made against this petitioner, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class at Jamshedpur in connection with Govindpur P.S. Case No. 108 of 2024. ( 2025:JHHC:14412 ) Page-2 6. It is made clear that till commencement of trial, the petitioner shall report to the local police station every month and after commencement of trial, he shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co-operate in trial and if any adverse report will come against the petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
