This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 39/2024 registered at Police Station Shyang, District Korba (C.G.), for the offence punishable under Sections 80, 3(5) of the Bhartiya Nyaya Sanhita, 2023. 2. According to the prosecution's story, the deceased, Poonam Tigga, was married to Ibrahim Tigga two to three months prior. After the ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.03.28 17:17:39 +0530 2 marriage, the deceased's husband, Ibrahim Tigga, and brother-in- law, Jaypal Tigga, demanded that the deceased bring a motorcycle as dowry from her maternal home. A day before the incident, a quarrel and dispute occurred between the deceased's husband and brother-in-law regarding the motorcycle. Allegedly, this led to the deceased committing suicide by hanging herself. Based on the inquest, a crime was registered, and the present applicant was arrested. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He submits that, as per the post-mortem report, no external injuries were found on the deceased's body, and it was suspected that the deceased died due to hanging, as a saree was found wrapped around her neck. He further submits that on the date of the incident, a quarrel arose between the applicant and his deceased wife, following which she committed suicide. Additionally, no suicide note was left behind by the deceased. He further submits the other co-accused, namely, Jaypal Tigga in MCRC No. 1874 of 2025 has already been granted bail by this Court vide order dated 07.03.2025, and the applicant is in jail since 07.01.2025, conclusion of the trial may take some time, therefore, he prays for grant of bail to the applicant on ground of parity. 4. On the other hand, learned State Counsel opposes the bail application of the present applicant and submits that the charge- sheet has been submitted before the competent Court in the present case. He submits that the applicant used to harass the deceased 3 over demands for dowry, which led to the deceased committing suicide by hanging, therefore, the applicant is not entitled for grant of regular bail in the present case. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, as well as the submissions of the learned counsel for the parties, this Court notes that although the learned counsel for the applicant stated that the deceased committed suicide due to a quarrel between the applicant and the deceased regarding serving food, this averment has not been made in the applicant's bail application, therefore, this Court is of the opinion that it is not a fit case to grant bail to the applicant. 7. Accordingly, the bail application of the applicant – Ibrahim Tigga , involved in Crime No. 39/2024 registered at Police Station Shyang, District Korba (C.G.), for the offence punishable under Sections 80, 3(5) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
