Neutral Citation No. - 2025:AHC:103240-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 262 of 2025 Petitioner :- Parmanand Respondent :- State of U.P. and 13 others Counsel for Petitioner :- Aishwarya Pratap Shahi, Parijat Srivastava Counsel for Respondent :- C.S.C., Rajiv Singh (S.C.) Hon'ble Arun Bhansali, Chief Justice Hon'ble Kshitij Shailendra, J. 1. This petition, purportedly in public interest, has been filed by the petitioner seeking removal of illegal encroachment by respondents no. 7 to 14 over Gata Nos. 490, 491 and 492 situated at Village Labaniya, Tehsil Tamkuhiraj, District Kushinagar as well as over Gata Nos. 1, 2 and 3 situated at Village Bharpatiya, Tehsil Tamkuhiraj, District Kushinagar. 2. Submissions have been made that petitioner has made repeated complaints, however, the same have not been attended by the respondents and that respondents no. 7 to 14 continue to be in encroachment over the government land and therefore, the respondents be directed to take appropriate action. 3. Under the direction of the Court, petitioner has filed supplementary affidavit inter alia producing pictures showing the alleged encroachment. 4. A perusal of the record indicates that in each subsequent complaint made by the petitioner, his complaint and the purported location of the encroachment have shifted/altered. In fact, the relief claimed in the petition is even beyond the complaints which have been made. The pictures produced along with the supplementary affidavit, also do not support the plea of the petitioner. 5. In view thereof, we do not find any reason to entertain the present petition, purportedly in public interest. The same is therefore, dismissed.
