THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, JUDGMENT WAS DELIVERED THEREIN AS UNDER: CORAM: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA and HON'BLE MR JUSTICE M.I.ARUN - 3 - NC: 2025:KHC:7176-DB CCC No. 78 of 2025 ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA) The following are the directions which are brought under the contempt jurisdiction of this Court by filing this contempt petition, as found in the order dated 03.08.2023 passed by learned Single Judge, "4. The writ petition stands disposed of with a specific direction to the 3rd respondent - Special Land Acquisition Officer - II, KIADB to consider the grievance of the petitioner for grant of compensation, on the ground that the petitioner is the owner of 1 Acre in Sy.No.37 of Haraluru Village, Channarayapatna Hobli, Devanahalli Taluk. The petitioner is also at liberty to pursue the remedy before the Tahasildar, Devanhalli Taluk in terms of the directions issued by the Assistant Commissioner. If the name of the petitioner is entered in the land records, the same can be brought to the notice of the Special Land Acquisition Officer so that he could take a decision in the matter of award of compensation." 2. A bare reading of the aforesaid directions would go to show that before the direction given to respondent No.3-the Special Land Acquisition Officer to consider the grievance of the petitioner for grant of compensation operates, the petitioner has to discharge her - 4 - NC: 2025:KHC:7176-DB CCC No. 78 of 2025 part of obligation by approaching the Tahsildar and getting the name entered in the land records. 3. When a query was put in this regard by the court to learned advocate Mr. R.R. Varun for the complainant, he was entirely at his receiving end to be able to submit only that the said procedures are still pending. 4. In that view, the question of compliance of the direction issued to respondent No.3-the Special Land Acquisition Officer-2, the Karnataka Industrial Area Development Board, does not arise since the other part of the requirement is not completed. No contempt is made out at this stage. 5. The petition is misconceived and it is dismissed. SD/- (N. V. ANJARIA) CHIEF JUSTICE SD/- (M.I.ARUN) JUDGE VMB List No.: 1 Sl No.: 1
