Also heard Shri S Dutta, learned Standing Counsel, P&RD Department, Assam. It appears that a shop in the Demow Multipurpose Building was allotted in the name of one Shri Nabin Gogoi which was, subsequently, leased to the petitioner by the said Nabin Gogoi vide a Tenancy Agreement dated 03.10.2023 and the petitioner was running a business in the name of ‘Fancy Bread House’. The lessor had, however passed away in September, 2024 and thereafter, the grievance of the petitioner is with regard to the allotment of the shop to the brother of the deceased. The dispute, if any, appears to be civil in nature. At this state, Shri Gogoi, learned counsel for the petitioner submits that he would like to withdraw this writ petition with a liberty to approach the appropriate Court.
