PUBLIC PROSECUTOR The Court made the following Order: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/A1, seeking regular bail, in Crime No.313 of 2021 of V.Madugula Police Station, Vishakhapatnam Rural, registered for the offences punishable under Sections 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution is that, on 22.11.2021, on receipt of credible information, the HC-1358 of V.Madugula Police Station along with his staff and mediators rushed to Ghat Road Junction, Sagaram Panchayat of V.Madugula Mandal and caught the accused in possession of 220 Kgs of Ganja. The 2 contraband along with other material was seized under the cover of mediators report. 3. Heard. Perused the record. 4. Learned counsel for the petitioner submits that basing on the confessional statement of co-accused, the petitioner herein/A1 is arrayed as accused in the present crime. In pursuant to the confessional statement, the petitioner herein was arrested on 29.12.2024 and since then he has been in judicial custody. Except the confessional statement, no other incriminating material is collected showing the complicity of the petitioner in the present crime. Learned Assistant Public Prosecutor opposed to grant bail on the ground that investigation in the present case is not completed. It is submitted by the learned counsel for the petitioner that the petitioner has permanent abode and there is no possibility of his fleeing away from the Jurisdiction of the Court. 5. In view of the facts and circumstances of the case, this court finds that further detention of the petitioner is no longer required to conduct further investigation and hence, this Court is inclined to grant bail to the petitioner herein/A1, on the following conditions. 3 i. The petitioner herein/A1 shall be released on executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional District & Sessions Judge-cum-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam. ii. On release, the petitioner shall appear before the Station House Officer concerned, once in a fortnight i.e., on 1st and 15th of every month between 10.00 AM and 01.00 PM., for a period of three (3) months. iii. The petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses. 6. Accordingly, the Criminal Petition is allowed. _____________________ T.
