Pandey, learned ACSC raises a preliminary objection with regard to maintainability of the writ petition by submitting that the present writ petition is not maintainable for the prayer sought in the same by the petitioner as the appeal, which has proposed to be filed, is not in a prescribed format as prescribed under Section 107 of the UPGST Act, 2017. Confronted with the said fact, learned counsel for the petitioner prays for withdrawal of the present writ petition with liberty to file a better petitioner. In view of the above, the writ petition is dismissed as withdrawn with the liberty aforesaid.
