Neutral Citation No. - 2025:AHC-LKO:41093 Court No. - 18 Case :- WRIT - A No. - 6494 of 2025 Petitioner :- Neeraj Respondent :- State Of U.P. Thru. Prin. Secy. Of Deptt. Of Child Development And Nutrition, U.P. Lko And 5 Others Counsel for Petitioner :- Brijesh Kumar Tiwari Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J. 1. Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties no.1 to 5. 2. In view of order being passed, notices to opposite party no.6 stand dispensed with. 3. Petition has been filed challenging appointment of opposite party no.6 as Anganbadi Worker in the village concerned and for a direction to opposite parties to consider petitioner's appointment on the said post. 4. It has been submitted that petitioner had also applied for recruitment on the said post in the village concerned and was placed at serial no.2 in the select list but opposite party no.6 Smt. Kusama wife of Amarjeet has been selected ignoring the Government Order dated 21.03.2023, particularly paragraph 12(iv) thereof with specifically prohibits two ladies from same family being employed in the same Anganbadi Centre. He has thereafter adverted to the letter dated 05.04.2025 submitted by the Child Development Officer, Chatoh, Raebareli admitting the fact that the mother-in-law of opposite party no.6, Smt. Kusama is already employed in the Anganbadi Centre concerned. It is therefore submitted that the selection and appointment of opposite party no.6 is clearly in violation of Government Order which does not prescribe any such relaxation. 5. Learned State counsel has not been provided any instructions till date despite time having been granted. 6. In view of submissions advanced by learned counsel for petitioner and upon perusal of material on record, it appears that there is certain discrepancy with regard to appointment of opposite party no.6 which may not be in conformity with paragraph 12 of the Government Order dated 21.03.2023. 7. However since factual aspects would require to be considered for redressal of petitioner's grievance, liberty is granted to petitioner to file a fresh representation before opposite party No.4 i.e. District Program Officer, Raebareli or any other competent authority. In case any such representation is preferred by petitioner, the same shall be decided in accordance with law after affording opportunity of hearing to all concerned within period of six weeks from the date a certified copy of this order is produced before the said authority. 8. With the aforesaid directions, the petition stands disposed of.
