Neutral Citation No. - 2025:AHC-LKO:39014 Court No. - 18 Case :- WRIT - A No. - 6645 of 2025 Petitioner :- Prashant Pandey Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home Deptt. Lko And 3 Others Counsel for Petitioner :- Apoorv Dev,Prashant Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J. 1. Heard learned counsel for petitioner and Mr. Uttam Kumar, learned State Counsel for opposite parties. 2. Petition has been filed challenging order dated 04.12.2024 whereby petitioner's representation was rejected. 3. Learned State Counsel has raised a preliminary objection regarding maintainability of this petition in view of fact that petitioner has not challenged either the punishment order or even the appellate and revisional orders and has challenged only the order whereby his representation was rejected. It is further submitted that since only a minor penalty has been imposed upon petitioner, he can very well approach the State Public Services Tribunal with regard to redressal of his grievance. 4. Learned counsel for petitioner submits that petitioner can very well approach the State Public Services Tribunal but the aspect of limitation may come in his way. 5. Considering the submissions advanced by learned counsel for the parties, it being evident that petitioner has an alternative and equally efficacious remedy before the Tribunal, liberty is granted to him to file a Claim Petition before the State Public Services Tribunal. The aspect of limitation may not come in the way of petitioner in view of subsequent order dated 04.12.2024. However, the said aspect is required to be considered by the Tribunal itself. 6. With aforesaid direction, the petition stands finally disposed of. Order Date :- 9.7.2025 kvg/- Digitally signed by :- GIREESAN KV High Court of Judicature at Allahabad, Lucknow Bench
