GP FOR CIVIL SUPPLIES The Court made the following ORDER: Heard Sri M M M Srinivasa Rao, learned counsel for the petitioner and Sri Md.Saleem, learned Government Pleader for Civil Supplies for respondents 2 to 5. 2. The above writ petition is filed to declare the action of respondents in not returning the stock of non-sortex rice delivered by the petitioners on 16.04.2021 and 07.04.2021, or reduce the stock from the ePoS device, as illegal and arbitrary. 3. Learned counsel for the petitioners would submit that both the petitioners returned the non-sortex rice to the MLS point, Nellore on 16.04.2021 and 07.03.2021 (Ex.P.2). Thereafter, the 1st petitioner made 2 representations dated 30.11.2022 (Ex.P.4) and 02.10.2023 to the Joint Collector, SPSR Nellore District to do needful. The Joint Collector, in turn, addressed letter (Ex.P.5) to the 5th respondent. Even the District Collector addressed a letter (Ex.P.10) dated 08.02.2024 to the 2nd respondent - learned Commissioner. However, neither the stock was returned nor the 2nd respondent reduced from ePoS device. 4. Learned standing counsel would submit that the issue is before the 2nd respondent, and the 2nd respondent will get a decision. Learned standing counsel submitted the instructions of the District CS Manager, dated 17.04.2025. 5. Given the facts and circumstances of the case, without going into merits of the matter, the writ petition is disposed of, at the admission stage with the consent of learned counsel on either side directing the 2nd respondent – The Commissioner, to take a decision, in pursuance of Ex.P.10 letter vide Rc.C1/34/2024, dated 08.02.2024 addressed by the learned District Collector and pass appropriate orders within four (4) weeks from the date of receipt of a copy of this order. No order as to costs.
