This writ petition has been filed under Article 227 of the Constitution of India by the petitioner for challenging the judgment and award dated 15.11.2011, whereby the Labour Court has decided the Adjudication Case No.135 of 2003, Sanjeev Kumar Vs. Vice Chairman, Mussoorie Dehradun Development Authority, in favour of respondent no.1-Workman. The petitioner-employer was directed to reinstate respondent no.1-Workman, on the post of Supervisor along with 20% of the back wages he was receiving. 5. Learned counsel for the petitioner on the last date submitted that the employer-M.D.D.A. may pay a lump sum amount to the respondent no.1-Workman as the matter is an old one and respondent no.1-Workman has almost reached at the age of superannuation and has left only three years of service to his credit. 6. This proposal floated by the petitioner-employer was agreeable to the respondent no.1-Workman and a request was made to the petitioner to come up with such a proposal. 7. Learned counsel for the petitioner-employer today submitted before this Court that the petitioner-M.D.D.A. is ready to pay a sum of ₹10,00,000/- to respondent no.1- Workman as lump sum amount towards full and final 2 settlement of his claims. 8. The proposal is accepted to the respondent no.1- Workman. 9. The payment of ₹10,00,000/- (Ten Lakhs) shall be made to the respondent no.1-Workman within a period of eight weeks’ from today i.e., on or before 11.12.2025. 10.
