The instant Criminal Appeal under Section 374 (2), Cr.P.C. challenging the judgment and order dated 13.05.2011 passed by Additional Sessions Judge, Court No. 6, Raebareli in Session Trial No.333/2006 (State Versus Vishambhar Singh and another), arising out of Crime No. 62/2005, under Sections 308/34, 325/34, 323/34, 504 and 506(2) IPC, Police Station- Bhadokhar, District-Raebareli, was filed by the appellants namely Vishambhar Singh s/o Sri Mahabal, Mankaudi Singh s/o Sri Tej Bahadur, both r/o Village Sanahi, Police Station-Bhadokhar, District-Raebareli. 3. Vide order dated 11.09.2018, the instant appeal was abated with regard to appellant no.1/Vishambhar Singh. The order dated 11.09.2018 reads as under:- "C.J.M. In-charge, Raebareli, vide report dated 11.1.2018 has reported that appellant no. 1 Vishambhar Singh son of Mahabal has expired on 15.4.2015. He has recorded the statements of S.I. Awadhesh Kumar Yadav witnesses, Shiv Shankar Tiwari, Smt. Meena Devi and Sidhnath Singh. The death certificate regarding death of Vishambhar Singh has been issued by Head Village Smt. Meena Devi and Registrar Birth and Death. In view of the above, the appeal so far as it relates to appellant no. 1 Vishambhar Singh stands abated. List revised. Case called out twice. None appeared on behalf of the appellant Mankaudi Singh. Perusal of record shows that appellant no. 2 is on bail and he is avoiding to get his case argued. Therefore, issue bailable warrants of Rs. 20,000/- against appellant Mankaudi Singh executable through C.J.M. concerned with the direction to ensure his presence before this Court on 12.10.2018. List this matter on 12.10.2018. On the said date, the appellant shall be present before this Court." 4. Further, office report dated 27.07.2021 submitted in compliance order of this Court dated 16.01.2019 and subsequent orders, learned CJM Raebareli has sent a report/letter no. 56 dated 05.02.2019 and according to the same the appellant no. 2 Mankaudi Singh has also passed away. The relevant portion of report/letter dated 05.02.2019 is extracted hereinunder:- "उपरोक्त विषयक द में मेंननय उच्च न्ययलय क जारो आदश पत्रांक सख्य 1057 दिदनदिकत 28-01-2019 जारिरोय डाक दिदनक 31-01-2019 क प्राप्त हु&आ। आदश क अन&पलन में अभि*य&क्त मेंनकडा भिसहु प&त्रां तजा बहुद&रो भिनस सनहु थान *दखरो जिजाल रोयबरोल क विरुद्ध जामेंनत रोण्ट क तमेंल थानध्य्क्ष *दखरो क प्रादत्त करोय गय। आख्य प्राप्त हु&ई दिक ------ अभि*य&क्त उपरोक्त क9 मेंत्य& 4-5 मेंहु प;< हु च&क9 हु=, ग्रामेंप्राधान क9 तहुरोरो सलग्न हु=। अभि*य&क्त क9 मेंत्य& आख्य तसदक हुत& समेंय प्रादन करोन क9 क्रप करो। तद्‌ न&सरो अन&पलन आख्य मेंननय उच्च न्ययलय अभिग्रामें आदश हुत& सदरो प्राविषत ।^ 5. Considering the aforesaid, the present appeal is also abated, so far as it relates to appellant no.2/Mankaudi Singh. 6. Accordingly, the appeal is consigned to record. Trial court's records if available before this Court, shall be sent back forthwith.
