By the present writ petition, the petitioner, who is presently working as Peon, Grade- IV (T) and is posted in Government Girls Higher Secondary School, Tatapani, district Balrampur, Ramanujganj is seeking a direction towards the respondents for necessary correction in the gradation list dated 01.04.2016 as the present petitioner has been placed below to his juniors i.e. respondents No. 6 to 10. 3 2. Learned counsel for the petitioner submits that though objection has been invited before finalization of the gradation list on 11.11.2024, but the petitioner could not raise the objection to the said gradation list, however the petitioner has filed representation before the District Education Officer on 17.02.2025 raising his grievance but till date the same has not been considered and decided. 3. Learned State counsel by referring communication dated 04.12.2024 of DEO submits that though objections were invited before finalization of gradation list till 11.11.2024 but, the petitioner failed to raise any objection to same and he has filed representation raising his grievance after finalization of the gradation list. She further submits that if the representation is still pending, the same will be decided in accordance with law by providing opportunity of hearing to all the parties within stipulated time. 4. I have heard learned counsel for the parties and perused the pleadings and the communication dated 04.12.2024 and the representation filed by the petitioner. 5. Perusal of the documents shows that petitioner has filed a representation before the DEO, Balrampur (respondent No. 5) on 17.02.2025 (Annexure P-5). 6. Considering the same, the respondent No. 5 i.e. District Education Officer, Balrampur is directed to decide the representation of the 4 petitioner in accordance with law by affording opportunity of hearing to all the parties above whom the petitioner is claiming seniority within a period of 60 days from the date of receipt of a copy of this order. 7.
