Neutral Citation No. - 2025:AHC-LKO:33894 Court No. - 18 Case :- WRIT - A No. - 6534 of 2025 Petitioner :- Prem Prakash Mishra Respondent :- State Of U.P. Thru. Prin. Secy., Revenue Deptt., Lko And 4 Others Counsel for Petitioner :- Kuldeep Kumar Srivastava,Mangal Sen Yadav,Pankaj Verma Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 5. By this petition, the petitioner has prayed for the following relief:- "i. Issue a writ, order or direction in the nature of Writ of Mandamus directing the opposite parties to consider the regularization of the petitioner on the post of Collection Amin under Rule 5 of U.P. Seasonal Collection Amin Rules, 1974 as amended from time to time, within stipulated period, specified by this Hon'ble Court. ii. Issue a writ, order or direction in the nature of Writ of Mandamus commanding the opposite parties to pay the regular monthly salary from month to month of the Calendar year to the petitioner. iii. Issue a writ, order or direction in the nature of Mandamus commanding and directing to opposite party no.3 te consider and decide the representation dated 22:25 submitted by petitioner with respect to regularization of his service on the post of collection amin, in the interest of justice." After arguing for sometime, learned counsel for the petitioner confines his prayer to the extent that the representation of the petitioner may be directed to be decided by respondent no.3. Learned Standing Counsel has no objection to this innocuous prayer. Perused the record. Considering the above, the petition is disposed of with liberty to the petitioner to move a fresh representation to respondent no.3 i.e. District Magistrate, Basti within two weeks' from today. If the petitioner submits a fresh representation, the respondent no.3 shall decide the same within four weeks' thereafter, by passing a speaking and reasoned order.
