By means of this writ petition, petitioners have sought a writ of mandamus directing the District Magistrate to demolish the illegal construction raised by respondent no. 4 and 5. (3) Learned State Counsel is right in submitting that private dispute cannot be agitated in public law remedy under Article 226 of the Constitution. In such view of the matter, writ petition is dismissed. However, petitioners shall be at liberty to approach competent civil court for appropriate relief.
