Sandeep Sharma, J. (Oral)
Petitioner herein, who at present is working as Head Master at Govt. High School Nayagran, Education Block Garola, Sub- Tehsil Holi, Tehsil Bharmour, District Chamba, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his pending representations dated 11.3.2025 and 24.4.2025 (Annexure P-3 and P- 5), whereby he has sought transfer from the aforesaid station to one of the stations of choice as detailed in the representation on account of the fact that he has completed normal tenure of posting in hard/tribal area. - 2 -
2. Averments contained in the petition, which is duly supported by an affidavit, reveal that petitioner has already completed normal tenure of posting at present place of posting, which is a hard/tribal area and as such, he has filed representations to the competent authority for his transfer to one of the stations of his choice in terms of transfer policy. 3. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for reply from the respondents, who are otherwise represented by Mr. Vishal Panwar, learned Additional Advocate General, who fairly states that representations, if not already decided, shall be decided expeditiously. 4. Since transfer policy itself provides for transfer of an employee, who has completed normal tenure of posting in hard/tribal area i.e. two winters and three summers, to seek transfer to one of the stations of his choice after completion of normal tenure of posting, this Court sees no impediment in accepting the prayer made by the petitioner. 5.
Consequently, in view of the above, this Court without going into the merits of the case deems it fit to dispose of the present petition with a direction to the respondents/competent authority to consider and decide his representations (Annexure P-3 and P-5), expeditiously, preferably, within a period of three weeks. Ordered
- 3 - accordingly. Needless to say, authority concerned, while giving personal hearing to the petitioner, may also take note of stations, which may have fallen vacant after filing of the representations. Pending applications, if any, also stand disposed of. May 15, 2025
