1. Heard.
2. The petitioner seeks following reliefs :-
"(i) To issue a writ order or direction in the nature of CERTIORARI thereby quashing the impugned order bearing No. 198 अ० प्र० क० /चभभाल स० स० कक षषि सषमिषत/2025-26 dated 08.05.2025 passed by the Opposite Party No. 4, contained as Annexure no. 1 to the Writ Petition viz-a-viz the notice issued through letter no. 156/ Vigyapan dated 02.05.2025 published in daily newspaper Dainik Jagran on 03.05 2025 and 04.05.2025 contained as Annexure No. 12 to the Writ Petition. (ii) To issue a writ order or direction in the nature of MANDAMUS restraining the Opposite Parties to not make any correspondence with the Petitioner in respect of the society namely Chabhal Joint Cooperative Farming Society Limited, Village Basaigapur, district Lakhimpur Khiri which has been winded up and after lapse of more than 20 year on the basis of the fictitious complaint made by the Opposite Party No 5."
3. We have perused Annexure no.1 to the petition dated
08.05.2025. In our opinion this does not give any cause to the petitioner to maintain this writ petition, as all that the impugned
order states is that the petitioner during his tenure as Secretary of the Co-operative Society had sold off certain parcels of land belonging to the Co-operative Society in the name of his family members, which is being enquired into by a four members committee, and the petitioner has been cautioned that if the petitioner or his family members enter into the land or cultivate
it then action would be taken as per law. This is hardly a matter to be interfered under Article 226 of the Constitution of India.
4. The writ petition is disposed of with liberty to the petitioner to avail other remedy as available to him under law. . (Praveen Kumar Giri, J.) (Rajan Roy, J.)
