By means of the instant transfer application, filed under Section 24 of the Code of Civil Procedure, 1908, the applicant seeks transfer of Family Case No.84 of 2025, Deepak Singh Bisht Vs. Smt. Anita Bisht (“the case”), from the court of Principal Judge, Family Court, Udham Singh Nagar to the court of Additional Principal Judge, Family Court, Haldwani, District Nainital.

Heard learned counsel for the parties and perused the record.

Learned counsel for the respondent has no objection if the case is transferred, as requested by the applicant. But, he submits that transfer may be made subject to the directions to the applicant not to seek any unnecessary adjournment.

Learned counsel for the applicant would submit that a divorce case has been filed by the respondent in the court at Udham Singh Nagar, whereas the applicant is a resident of Haldwani, District Nainital. Maintenance case between the parties is also pending in Haldwani, District Nainital. Therefore, both the
2 cases may be transferred. He would submit that the applicant would not seek any unnecessary adjournment.

Having considered the submissions as made, this Court is of the view that the case may be transferred from the court of Principal Judge, Family Court, Udham Singh Nagar to the court of Additional Principal Judge, Family Court, Haldwani, District Nainital. Accordingly, transfer application deserves to be allowed.

Transfer application is allowed.

Family Case No.84 of 2025, Deepak Singh Bisht Vs. Smt. Anita Bisht is transferred from court of Principal Judge, Family Court, Udham Singh Nagar to the court of Additional Principal Judge, Family Court, Haldwani, District Nainital.

Needless to say that unnecessary adjournment shall not be entertained by the court while dealing the case.

Let a copy of this order be sent to both the courts.
