Heard learned counsel for petitioner and learned State Counsel for opposite parties no. 1 to 4. 2. In view of order being passed, notice to opposite party no. 5 stands dispensed with. 3. Petition has been filed challenging final select list issued for the post of Aganwadi Worker in Center Jinautha, Gram Sabha Tulsipur, Project Jamunha, District Shrawasti. 4. Ms. Parul Bajpai, learned Additional Chief Standing Counsel has been provided written instructions dated 09.7.2025, which are taken on record and as per which although petitioner obtained the higher cut-off merit mark of 21.597 but the opposite party no. 6 despite having lower merit of 10.228, was selected since she belonged to the below poverty line category while petitioner belonged to the above poverty line category and therefore, opposite party no.6 was required to be given preference in terms of Government Order dated 21.03.2023. 5. Considering aforesaid facts and circumstances, it is evident that the opposite party no. 6 despite being made in merit was required to be given preference in terms of Government order date 21.03.2023, this Court does not find any occasion to grant indulgence. 6. Resultantly, the petition fails and is dismissed. Parties to bear their own cost.
