Affidavit-of-service filed on behalf of the petitioners be kept with the record. The father of the petitioner was an Assistant Teacher at Kirtan Khali Free Primary School, a school under Sagar Circle of 24- Parganas (South) District Primary School Council. On attaining the age of superannuation, he had retired from his said service on May 31, 1990 and had died on April 09, 2020. The mother of the petitioner had predeceased the father. The petitioner, after the death of the father being his widowed daughter, has applied for family pension. The petitioner is complaining delay in disbursement of the said pension. Ms. Roy Chowdhury, learned Advocate for the State draws my attention to Annexure ‘P- 6’ to the writ petition which is the letter dated December 26, 2023 issued by the Sub-Inspector of Schools Sagar Circle, the respondent no.5 herein requesting the petitioner to furnish the
2 documents mentioned in the said letter. Ms. Roy Chowdhury submits that those documents have not yet been submitted. Mr. Maity, learned Advocate for the petitioner denies the said allegation and submits that such documents have been supplied. Record does not demonstrate submission of the documents mentioned in the said letter however, if the same has not yet been submitted, the petitioner is required to submit the same within a week from date. On availability of the said documents, the respondent no.5 shall take steps to complete the pension file of the petitioner and thereafter shall send the same to the concerned authority for preparation of pension payment
order in accordance with laws. The respondent no.5 shall complete his drill in this regard as expeditiously as possible preferably within a period of four weeks from the date of availability of all relevant documents. WPA 5694 of 2024 is, thus, disposed of without any order as to costs. Urgent photostat certified copy of this
order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Biswajit Basu, J.)
