Neutral Citation No. - 2025:AHC-LKO:34788-DB Court No. - 2 Case :- WRIT - C No. - 5353 of 2025 Petitioner :- Vindeshvari Prasad Ojha Respondent :- Chairman,Bharat Petroleum Corp. Ltd. Mumbai And 4 Others Counsel for Petitioner :- Vishnu Kumar Srivastava,Divya Malviya,Siddharth Tripathi Counsel for Respondent :- Mohammad Ehtesham Khan,C.S.C. Hon'ble Rajan Roy,J. Hon'ble Praveen Kumar Giri,J. Heard learned Counsel for the petitioner, Shri M.E. Khan,
learned Counsel for the opposite parties no. 1 to 3 and learned Standing Counsel for the opposite party no. 4. The opposite party no. 5 was allotted a dealership for supply of gas cylinders by the opposite party no. 3 Corporation. She did not adhere to the terms and conditions of the allotment, accordingly, the supply was stopped by opposite party no. 3 to opposite party no. 5. Consequently, the opposite party no. 5 is not running the gas agency. The petitioner claims to be the owner of the premises where the gas agency was being run. Now, he has come to Court seeking a Mandamus that in view of the aforesaid scenario, the opposite party no. 3 should itself run the gas agency in the premises of the petitioner. We are not aware of any law under which we could issue any such direction, much less a writ of Mandamus. The Counsel should be cautious while drafting such writ petitions and filing it before the High Court. The petition is absolutely ill advised and not maintainable. The writ petition is accordingly dismissed.
