A JAYANTHI The Court made the following: 4 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO CONTEMPT CASE No.4164 of 2025 ORDER: W.P.No.4118 of 2025 has been filed challenging the inaction of the respondents in taking appropriate action on erection of statue by demolishing the Anganwadi School contrary to the directions given by the Hon’ble Apex Court in S.L.P.(Civil).No.8519 of 2006 dated 18.01.2013 and G.O.Ms.No.18, Transport, Roads & Buildings (Roads-1) Department, dated 18.02.2013. 2. The Hon’ble Apex Court, after summarizing the arguments in the supra referred case, directed all the State Governments not to grant permission for installation of statues or structures on public roads, pavements, highways and in other public utility places. 3. This Court, in W.P.No.4118 of 2025 vide order dated 25.02.2025, directed the respondents to follow the guidelines of the Hon’ble Apex Court, before giving any permission for erection of a statue. 4. The learned counsel for petitioner sought to direct the official respondents not to grant permission to the unofficial respondents for erecting a statue. 5. The learned counsel for unofficial respondents filed counter-affidavit and stated that unofficial respondents have filed an application before the Gram Panchayat seeking permission for erection of a statue, as the land belongs to the Gram Panchayat. Subsequently, the unofficial respondents have also filed an application before the District Collector seeking permission for erecting a statue. When the unofficial respondents came to know about the orders of this Court, they have not attempted to erect a statue and tendered unconditional apology in the affidavit. 6. The learned counsel for official respondents also filed counter-affidavit and stated that they have not granted any permission for erecting a statue. 5 7. Recording the said submissions, the Contempt Case is closed. However, the official respondents are directed to dispose of the application filed by the unofficial respondents for erection of a statue as expeditiously as possible. 8. The unofficial respondents are directed not to unveil the statue. The learned counsel for official respondents is orally directed to suggest the respondents to make appropriate steps for removal of the statue, which is placed on the pile. 9. There shall be no order as to costs.
