PUBLIC PROSECUTOR The Court made the following: Order: [[ This Criminal Petition has been filed by the petitioners/A1 to A6, A9 & A10, seeking anticipatory bail, in connection with Crime No.57 of 2025 of Patamata Police Station, NTR District. 2. A case has been registered against the petitioners herein and others for the offence punishable under Sections 420, 341, 506 r/w 34 of IPC. 2 3. Learned counsel for the petitioner, after arguing for some time, has confined his argument to the extent of protecting the petitioners herein from the coercive action by the police on the ground that the offences alleged are punishable with imprisonment upto seven years and less than seven years and prays this Court to direct the police to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. On the other hand, learned Assistant Public Prosecutor did not oppose the same and concurred with the submission made by the learned counsel for the petitioners for the reason that the offences alleged are punishable with imprisonment upto seven years and less than seven years. 5. Heard. Perused the material on record. 6. As the offences alleged are punishable with imprisonment upto seven years and less than seven years, this Court is inclined to dispose of the criminal petition with the following conditions: (i) This Court directs the police to follow the procedure as contemplated under Section 35(3) of the Bharatiya 3 Nagarik Suraksha Sanhita, 2023, scrupulously, as per the guidelines enunciated in Arnesh Kumar Vs. State of Bihar and another1. (ii) The petitioners shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. 7.
