Heard Sri Asutosh Sachan, Advocate holding brief of Sri Ajeet Kumar Singh, learned counsel appearing for the petitioners. 2. In view of the order proposed, notice to Respondent No. 2 is hereby dispensed with. 3. The instant petition has been filed under Article 227 of the Constitution of India seeking following reliefs: "Wherefore, it is most respectfully prayed that this Hon'ble court may graciously be pleased to direct to O.P. No-1 i.e., Civil Judge (J.D) Musafirkhana, Sultanpur to conclude the proceeding of Regular Suit No- 18/2022, Sunita Devi & others Versus Dipak & another and pass final order in accordance with law within stipulated period without granting unnecessary adjournment to either parties, in the interest of justice. Any other order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case in favor of the petitioners, in the interest of justice." 4. Learned counsel appearing for the petitioners has submitted that the petitioners have filed a civil suit i.e. Regular Suit No. 18 of 2022 (Sunita Devi & Others Vs. Dipak & Another) in the court of learned Civil Judge (Junior Division) Musafirkhana, Sultanpur and the said suit is pending since the year 2022. It has further been submitted that the order in this suit, had already been passed regarding ex-parte proceedings but the learned trial court till date, has not concluded the proceedings. 5. Learned counsel appearing for the petitioners has thus argued that it would be in the fitness of things if this Court may issue a direction to the learned trial court to hear and decide the suit in question expeditiously. 6. I have considered the submissions made by the learned counsel appearing for the petitioners and I find that the Regular Suit No. 18 of 2022 (Sunita Devi & Others Vs. Dipak & Another) is pending before the court of learned Civil Judge (Junior Division) Musafirkhana, Sultanpur, since the year 2022. 7. In view of the aforesaid reason, this writ petition is disposed of with a direction to learned Civil Judge (Junior Division) Musafirkhana, Sultanpur to hear and decide the Regular Suit No. 18 of 2022 (Sunita Devi & Others Vs. Dipak & Another), expeditiously. Order Date :- 6.6.2025 A. Mandhani Digitally signed by :- ABHISHEK MANDHANI High Court of Judicature at Allahabad, Lucknow Bench
