Mr. Deep Chandra, Advocate for the petitioner. Mr. Suyash Pant, Standing Counsel for the State. 2. Petitioner took loan of Rs. 1,00,000/- from Sadhan Sahkari Samiti, Bageshwar, in the year 2020. Since petitioner has committed default in repayment of loan, therefore, a recovery citation has been issued against him by Tehsildar, Bageshwar for recovery of Rs. 83,307/- plus recovery charges and other expanses. 3. Leaned counsel for the petitioner submits that due to family problems, petitioner could not repay the loan as per schedule which has led to issuance of recovery citation. He submits that petitioner is ready and willing to repay the loan; however, due to financial constraints, he is not in a position to repay the loan in one go and needs time so that he may liquidate the loan in instalments. 4. Learned State Counsel submits that if petitioner has any grievance, then he can approach the competent authority in the concerned cooperative society which lent money to the petitioner. 2025:UHC:9474 5. The writ petition is, accordingly, disposed of with liberty to petitioner to approach the competent authority in the concerned cooperative society by making representation. If petitioner makes such representation within one week from today, the competent authority shall take decision thereupon within three weeks thereafter. Petitioner shall deposit a sum of Rs. 10,000/- along with the representation to show his bonafide. 6. For a period of four weeks or till the decision on petitioner’s representation is taken, whichever is earlier, no coercive action shall be taken against him. However, in case petitioner fails in making representation and also in depositing the amount in terms of this order within stipulated time, then concerned authority shall be at liberty to proceed for recovery of the outstanding dues, as per law.
