N RANGA REDDY 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 10322 of 2021 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue a writ, order or direction more particularly one in the nature of mandamus declaring the action of the respondents police 4 and 5 in interfering with the civil disputes in between the petitioner and respondents 6 and 7 during the pendency of the civil suit in OS No. 261 of 2020 before the Junior Civil Judge, Hindupur as illegal, arbitrary and violation of article 14 and 21 of constitution of India and consequently direct the respondent police not to interfere in the civil disputes and pass….” 2. Heard Sri P.Narasimhulu, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioner would submit that the respondent police are calling the petitioner to the police station without there being any crime registered against him and interfering in the civil disputes between the petitioner and unofficial respondents. 4. Learned Assistant Government Pleader for Home for the respondents brought to the notice of this Court that in compliance of the interim Order passed by this Court dated 14.06.2021, the respondent-police are not calling the petitioner to the police station, since no crime has been registered against the petitioner and they are not interfering in the civil disputes between the parties. Learned Assistant Government Pleader on written instructions would 4 further submit that during enquiry, it is revealed that there is a dispute pertaining to Sy.No.30 between one K.Sreeramulu of Demakethepalli and P.Narasimhappa of D.Gollapalli Village of Chilamathur Mandal which is subject matter in Cr.No. 106 of 2021 under Sections 447, 427, 506 of IPC and Cr.No.117 of 2021 under Sections 341, 323 r/w 34 of IPC of Chilmathur P.S and in the said two cases, though Sy.No.30 is mentioned, the petitioner or the unofficial respondents are no way connected to the disputes. 5. Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 6. Considering the submissions, this Writ Petition is disposed of. However, the police are directed not to call the petitioner to the police station in absence of any crime registered against him. The police are further directed not to interfere in the civil disputes between the parties. There shall be no order as to costs.
