Order on Board 26/03/2025
1. The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.511/2024, GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.03.27 14:40:22 +0530
2 registered at Police Station –Kawardha, District Kabirdham (C.G.) for the offence punishable under Sections 80, 3(5) of Bhartiya Nyaya Sanhita,
2023. 2. Case of the prosecution, in brief, is that the deceased committed suicide on intervening night on 24.08.2024 at about 2 pm by hanging on mayar (yard stick) by using towel, due to demand of dowry made by applicant. 3. Learned counsel for the applicant submitted that the applicant though is the husband of the deceased but an independent person who is of the village has stated that the deceased frequently visited her parents house and she was left at the house of the applicant, hence under depression she committed suicide. Therefore, learned counsel prays for grant of bail to the applicant. 4. On the other hand, learned counsel for the State opposes the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, also considering the fact that as per the postmortem report, the deceased died no doubt of asphyxia as a result of antemortem hanging but there were some multiple abrasion over the hand as well as two contusions were found on her arm and right side leg and the mother of the deceased in her statement under 161 Cr.P.C. she had stated that the applicant used to cruelly treat and
3 assault the deceased who used to come to the parents house and complain the same, therefore this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7.
7. Accordingly, the bail application of applicant- Vishram Diwakar @ Chotu involved in Crime No.511/2024, registered at Police Station –Kawardha, District Kabirdham (C.G.) for the offence punishable under Sections 80, 3(5) of Bhartiya Nyaya Sanhita, 2023 is rejected. 8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information. Sd/- (Ramesh Sinha)
