Heard the counsel for the petitioner. 2. The present petition has been filed challenging an order whereby the request for appointment of Commissioner under Order 26 Rule 9 was dismissed as well as an order whereby the recall of the said order was also rejected. 3. Considering the fact that there was no error in the rejection of the application for appointment of the Commissioner, the same was rightly rejected. 4. As the suit is of the year 2002, the JSC Court is directed to conclude the hearing of the suit No.4 of 2002 within a period of six months and send a report to this court. 5. The Senior Registrar of this Court is directed to communicate this order to the court concerned for conclusion of the hearing within six months. 6. In case, any adjournment is sought by any of the parties, at least a cost of Rs.5000/- shall be imposed. 7. The writ petition stands disposed off.
