Learned Senior Counsel for the petitioner submits that though pursuant to the decision in Rajesh Kumar Sharma Versus SJVN Ltd. and another2, respondent No.1 had rejected the representation of the petitioner on 07.05.2025 (Annexure P-6), however, in the

given facts and circumstances, petitioner be permitted to file a fresh representation to respondent No.1, pointing out certain vacancies where the petitioner can be adjusted, whereafter, respondent No.1 be directed to decide the same in accordance with law within a time bound schedule. Learned Senior Counsel also urged that in the peculiar
facts and circumstances, respondent No.1 be directed to withdraw the impugned order dated 07.05.2025.

Sh. Anup Rattan, learned Senior Counsel appearing for respondent No.1 submitted that respondent No.1 is not averse to consider the fresh representation to be preferred by the petitioner in accordance with law. He also submits that in view of petitioner’s filing fresh representation for his adjustment, order dated 07.05.2025 be deemed to have been withdrawn.

Having regard to above submissions, present writ petition is disposed of by permitting the petitioner to prefer a fresh representation to respondent No.1 for his adjustment, within two days from today. On receipt of such representation, respondent No.1 shall consider and decide the same in accordance with law and pass appropriate
order within two working days thereafter, latest by

21.05.2025. The decision so arrived at shall also be communicated to the petitioner.
The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
