The applicant has preferred this Second Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 72/2024, registered at Police Station Fasterpur, District-Mungeli (CG) for the offence punishable under Sections 103(1), 109(1), 191(2), 191(3), 190, 2 61(2)(A) of BNS, 2023. 2. The prosecution story in brief, is that, the complainant has lodged report to concerned police station to the effect that on 25.08.2024 his elder brother Bhagbali Patle, Vakil Patle, Kaushal Patle, sister- in-law Santoshi were standing in front of this brother Makhan Patle’s house in Vilage Gigtara. At the same time he went to a place about 150 meters away form his house after hearing the sound of a fight. He saw that the accused Kejuram Patle, Toran Patle, Makhan, Rambali, Chitrekha, Rajni, Meenakshi, Gaidlal @ Paklu, Lalla armed with sticks and rods abused Bhagbali, Valkil Patle, Kaushal Patle, Santoshi Patle over a land dispute and beat them with stick and rod, made a fatal attack and caused serious injuries. The accused Kejuram Patle drove his tractor E series and ran over his brother Bhagbali Patle and crushed him with the vehicle, due to which Bhagbali died on the spot and the other persons were seriously injured. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant is in jail since 03.10.2024 and is aged about 82 years, charge sheet has been filed and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. He further submits that there are 8 previous criminal 3 antecedents against the present accused. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, previous criminal antecedents of the accused, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Toran Patle involved in Crime No. 72/2024 under Sections 103(1), 109(1), 191(2), 191(3), 190, 61(2)(A) of BNS, 2023 at Police Station- Fasterpur, District- Mungeli, Chhattisgarh, is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously preferably within 8 months from the date of receipt of copy of this order, in accordance with law, if there is no legal impediment. 8.
