1. Respondent no. 1 is represented by the learned advocate.
2. Nobody is present to represent the appellant in this case.
3. It appears that the instant appeal was dismissed for default on earlier occasion by passing an order of the Co- ordinate Bench of this Court dated 7th August, 2024. Thereafter, an application was taken out at the behest of the appellant with a prayer for restoration of the said appeal. The said application was allowed by passing an order of this Court dated 17th August, 2025.
4. On earlier two occasions, the appellant was found absent. A letter of intimation is handed over by the learned advocate for the respondents that the learned advocate for the appellant was duly intimated about the date fixed for hearing. Despite receiving such intimation, appellant does not venture to appear before this Court.
5. It appears that this appellant has lost interest to proceed further with the present appeal and as such, I have no option but to dismiss the present appeal.

6. Accordingly, the instant appeal be and the same is hereby dismissed for default. Interim order, if any, stands vacated.
7. No order as to costs.
8. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.
9. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities.
