Heard Sri Rajeev Kumar Mishra Rudra, the learned counsel for the applicant, Sri Anant Pratap Singh, learned A.G.A. for the State and perused the records. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 480/2024, under Sections 80(2), 85 B.N.S. & 3/4 D.P. Act, Police Station Paraspur, District Gonda. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 26.12.2024 against the applicant, her husband and three sons, stating that the informant had get her daughter married to the applicant's son co-accused Surya Pratap Singh in the year 2022. All the accused persons used to harass her and they informed that she has hanged herself on 26.12.2024. 4. The inquest proceedings were witnessed by the informant and he did not level any allegation at that stage. The post mortem examination report mentions a ligature mark around neck with gap of 4 cm. on left side. An old healed abrasion of size 1 cm. x 0.1 cm. over left side of lower back. The cause of death has been has been opined to be asphyxia due to ante mortem hanging. 5. In the affidavit filed in support of the bail application, it has been stated that the applicant is a 55 years old innocent woman having no criminal history and she has been falsely implicated in the present case. 6. Learned A.G.A. has opposed the bail application and he has submitted that the allegations have been established during investigation, a charge-sheet has been submitted on 27.03.2025 and cognizance has been taken on 04.04.2025. 7. Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the deceased has died due to hanging; there is no specific allegation against the applicant, the applicant is a 55 years old innocent woman having no criminal history and she is languishing in jail since 06.01.2025 whereas the investigation already stands concluded, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime. 8. Accordingly, this bail application stands allowed. 9. Let the applicant-Lalli be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court.
