The petitioner has challenged an internal communication between the Managing Director of U.P. Mahila Kalyan Nigam with the District Probation Officer, Farrukhabad regarding a proposed recovery from 27 institutions including the petitioner. In fact, the recovery from the other institutions has been made, but the recovery from the petitioner has not been affected, therefore, a request has been made for the same. However, no citation of recovery has been issued as yet. In our opinion, unless a citation of recovery is issued by the revenue authorities or any other officer addressed to the petitioner, a cause of action will not arise. The question as to whether the money could be recovered as arrears of land revenue would be considered accordingly, at the appropriate stage. The petitioner may, however, if he has a cause, represent to the concerned authorities against the proposed recovery which can be considered by them. The writ petition is disposed of in the aforesaid terms.
