Neutral Citation No. - 2025:AHC-LKO:33964 Court No. - 18 Case :- WRIT - A No. - 6470 of 2025 Petitioner :- Smt. Kalpana Respondent :- State Of U.P. Thru. Prin. Secy. Bal Vikas Sewa Evam Pushtahar Vibhag Lko. And 4 Others Counsel for Petitioner :- Adarsh Srivastava,Hemant Kumar Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 4. Notice to respondent no.5 is dispensed with in view of the proposed order. The petition seeks issuance of a writ in the nature of certiorari for quashing the impugned selection of respondent no.5. Further, a writ in the nature of mandamus is prayed for, directing the respondents to appoint the petitioner to the post of Anganwadi Karyakarti. Perused the record. A perusal of the record reveals that the petitioner had submitted a complaint dated 06.04.2025 regarding alleged irregularities in the selection process. The said complaint was decided by the District Development Officer, District Barabanki, by an order dated 07.05.2025. While deciding the complaint, it was observed that the selected candidate, Saroj Kumari, belongs to the BPL (Below Poverty Line) category and had secured 7.84 marks. As per the Government Order dated 21.03.2023, priority is to be given to BPL candidates. Though the petitioner had secured 13.4 marks, she belongs to the APL (Above Poverty Line) category and therefore could not be selected, in view of the priority accorded to BPL candidates under the applicable Government Order.
I find no illegality in the selection process. The writ petition, being devoid of merit, is accordingly dismissed. Order Date :- 30.5.2025 Madhu D.R/P.S Digitally signed by :- MADHU KUMARI High Court of Judicature at Allahabad, Lucknow Bench
