Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents. This petition has been filed with the following prayers:- "i. Issue a writ, order or direction in the nature of mandamus commanding the opp. parties not to demolish the respective shops of the petitioner over Khata no- 442 Mi, (old No.193) area 0.7710 situated at Gram Onai Pahadpur Tehsil Raibareli District-Raibareli as no notice till date have not been given to the petitioner. ii. Issue a writ, order or direction in the nature of mandamus commanding the opp. party no-2 to decide the representation dated 15-05-2025 as contained as Annexure No.4 to this writ petition, to meets the ends of justice." Learned counsel for the petitioner has prayed that a direction be issued to the District Magistrate/Collector, Raibareli to decide the representation made by the petitioners on 15.5.2025. Learned counsel for the State-respondents has pointed out that it appears that the petitioner has taken over the land belonging to the Gram Samaj and has constructed the shops over it. Without entering into the merits of the case, we direct the Sub Divisional Magistrate concerned to summon the report from the Tehsildar, Tehsil Sadar, Raibareli and then pass an appropriate order within three weeks from the date of the production of copy of this order.
