Petitioner took a loan from Bank of India, Bageshwar Branch in the year 2019. Since there was some default on the part of the petitioner, therefore, the bank has issued a recovery certificate, pursuant to which Tehsildar, Bageshwar has issued citation for recovery of `1,68,086/- + other charges. Thus, feeling aggrieved by the recovery citation, petitioner approached this Court. 5. Learned counsel for the petitioner submits that due to some family problems, petitioner could not deposit the installments in time, which has resulted in issuance of recovery certificate against him. He submits that, if given an opportunity, petitioner will repay the entire loan in twelve monthly 2025:UHC:9740 installments. 6. Mr. Ajay Singh Bisht, learned counsel appearing for the bank submits that if petitioner makes upfront deposit of `30,000/- to show his bonafide, within 30 days from today, then he can be permitted to deposit the remaining amount in eleven monthly installments. 7. In such view of the matter, the writ petition is disposed of with the following directions:- i. Petitioner shall deposit `30,000/- with the concerned Branch of the bank within 30 days from today. Subject to fulfilment of the aforesaid condition, he may be permitted to deposit the remaining amount in eleven equal monthly installments, amount whereof shall be fixed by the Branch Manager. The last installment shall carry the component of interest and other expenses also. ii. In case of any default on the part of the petitioner, the respondents shall be at liberty to proceed against petitioner, as per law.
